Please pay special attention to the terms in bold. They concern your important rights, our disclaimers and limits of liability, and how disputes are resolved.

1. Acceptance and scope

1.1 These Terms are the agreement between you and us on your use of the Rideo app (iOS and Android, the "Service"). By registering, signing in to or using the Service, you agree to these Terms and confirm that you have read our Privacy Policy. If you do not agree, please do not use the Service.

1.2 You must be at least 16 years old to use the Service.

1.3 The Service is currently offered to users in the following countries / regions: mainland China, South Korea, the European Union, the United Kingdom, the United States, and other countries and regions.

2. The Service

2.1 Rideo lets you record and review cycling and other workouts, and turn activities into posters, videos, 3D works and more; Explore is for browsing works that other users have published publicly.

2.2 Free: the Service is currently entirely free, with no in-app purchases and no ads. We may add paid features in the future; if we do, we will tell you in advance and explain what is charged for. Your existing data will not be deleted because paid features are added.

2.3 The Service may change: we may add, change, suspend or end some features, and the Service may be interrupted for maintenance, faults or force majeure. We will notify you in advance of changes that significantly affect you. We do not guarantee that the Service will be uninterrupted or error-free.

2.4 Creating works takes time and a network connection: 3D works are processed on our rendering server. How long they take depends on the workload and the network, and we do not guarantee that each one will finish within a particular time or will always succeed.

2.5 Automatic cloud sync: once you sign in, activities you save or import are automatically uploaded to the cloud as a backup, and there is currently no switch to turn this off. See Section 3.3 of the Privacy Policy.

3. Your account

3.1 You can sign in with an email verification code, or with an Apple or Google account. Please provide a real email address at which you can be reached.

3.2 You should keep your sign-in methods safe and are responsible for activity under your account. If you find that your account has been misused, contact us right away.

3.3 Each individual should use only one account. Accounts may not be rented, sold or transferred.

3.4 You can request account deletion in the app or by email. Deletion has a 30-day waiting period during which you can cancel it by signing in and tapping "Cancel deletion"; once it ends, your cloud data is deleted and cannot be recovered. See Section 10 of the Privacy Policy for details. During the waiting period, works you have published and share links you have turned on remain public, and you cannot unpublish or stop sharing during this time; if you want them taken down right away, unpublish and stop sharing before you request deletion.

4. Your content

4.1 Ownership: you keep the rights to the content you create and upload to the Service (tracks, workout data, reduced-size photo copies, titles, nickname, profile photo, your parts of the works you create, etc., together "User Content"). We do not claim ownership.

4.2 Scope of license: to provide the Service to you, you grant us a non-exclusive, worldwide, royalty-free license, limited to the following uses:

  • storing, backing up, transmitting and processing User Content, including processing on our servers, at the cloud providers we engage and on our rendering server (Privacy Policy Sections 5 and 9);
  • converting formats, cropping and compositing User Content as needed to create the posters, videos and 3D works you request;
  • only when you publish to Explore or turn on a share link, displaying that content within the Service for other users to view (a work published to Explore is shown together with all reduced-size photos of that activity and their capture times, including photos added after publishing; see Privacy Policy Section 8.1), and letting signed-in users download the GPX track processed under the rules (500 m cut from both the start and the end, with a daily download limit).

Outside the scope above, we will not use your User Content: not for advertising or promotion, not for sale, and not licensed to others. If we want to use your work in our promotion, we will first ask for your separate consent.

4.3 License term: the license lasts as long as the User Content is stored in the Service. After you unpublish a published work, stop sharing a link or delete your account, we will stop displaying it and delete it in line with the Privacy Policy. Note: deleting an activity does not automatically unpublish works published from it; you need to unpublish them separately (see Privacy Policy Section 8.3). We cannot retrieve copies that others have already downloaded, screenshotted or forwarded.

4.4 Your promises: you promise that you have the necessary rights to the content you upload and publish; that if your photos include other people's likeness or private information, you have obtained the necessary consent; and that the content you publish does not infringe the legal rights and interests of others.

4.5 A reminder about location privacy: when a route is made public, 500 m near both the start and the end is cut off, but the middle part of the route, the content of photos and the title may still reveal where you are active or your daily patterns. Please use your own judgment before publishing, and do not publish anything you do not want made public.

5. Rules of conduct and content moderation

We have zero tolerance for illegal or objectionable content and for harassing others.

5.1 You must not:

  • publish or spread illegal content, or content that infringes others' intellectual property, portrait rights, privacy or reputation;
  • publish pornographic, violent, hateful, harassing, fraudulent or spam content, or content that harms minors;
  • publish content containing other people's home addresses or other sensitive personal information, or use other people's routes to locate or track them (for example, working out someone's home or the places they often go from routes they have made public, and then finding or following them);
  • falsify data to mislead others, or impersonate another person or organization;
  • interfere with or attack the Service, get around rate limits or download limits, scrape other users' content in bulk, or reverse engineer or crack the Service (except where the law expressly allows it);
  • use the Service for any illegal activity.

5.2 How we moderate content:

  • Works become public as soon as they are published, and we do not review them manually in advance. Work titles and nicknames go through an automatic keyword check when submitted: if one contains illegal or inappropriate words, the submission is rejected and you will be asked to change it. Apart from this, we do not use automated tools to screen or remove content.
  • Signed-in users can report works in Explore within the app; anyone can report by emailing support@tooo.live. Reports are reviewed manually by our staff, and we will handle them as soon as we can; after handling a report, we will tell the reporter the outcome (see Section 5.6).
  • When we believe content violates these Terms or the law, we may remove it without prior notice; for serious or repeated violations, we may terminate the account, meaning we delete that account and its data (for the scope of deletion, see Privacy Policy Section 10.2). Authors cannot republish works that we have removed.
  • When we remove your work or terminate your account, our staff will tell you the outcome, the reasons and the grounds by email to your account's email address (unless the law prohibits us from telling you or we cannot reach you). If you disagree, you can reply to that email or write to support@tooo.live to appeal, and a person will review the decision again and reply.

5.3 Blocking: you can block an author so you no longer see their works.

5.4 Contact email: if you object to content or want to make a complaint, contact support@tooo.live. This email address is also shown on the "About Rideo" page in the app.

5.5 Copyright and other rights complaints: if you believe some content infringes your copyright or other rights, email support@tooo.live and include:

  • your name and contact details;
  • the work or right that has been infringed, and proof that you are the rights holder or are authorized;
  • where the allegedly infringing content is (for example, the work's title, the author's nickname, a screenshot);
  • a statement that you believe in good faith that the use is not authorized by the rights holder, its agent or the law, and that the information you have provided is true and accurate.

Once we receive a notice that meets the requirements above, we will check it and remove the content where necessary, and tell the publisher under Section 5.2. If the publisher believes the removal was a mistake, they can appeal with an explanation and supporting evidence; we will pass the appeal on to the complainant and decide whether to restore the content based on both sides' materials. We will terminate the accounts of repeat infringers.

5.6 EU Digital Services Act: as required by the EU Digital Services Act, the practices already described in this section are summarized here:

  • Reporting: signed-in users can report works in Explore within the app; anyone can report illegal content by emailing support@tooo.live (Sections 5.2 and 5.5).
  • Automated tools: we use an automated tool in one place only, the keyword check on work titles and nicknames when they are submitted. Submissions containing illegal or inappropriate words are rejected, and you are told why (Section 5.2). We do not use automated tools to detect or remove published content. Reports are reviewed manually by our staff, and decisions to remove content or terminate accounts are also made by people.
  • Reasons and appeals: when we remove your work or terminate your account, we will tell you the outcome, the reasons and the grounds by email; you can reply to appeal, and a person will review the decision again (Section 5.2). You can also seek redress before the courts.
  • Informing reporters: after handling a report, we will tell the reporter the outcome: by email to the reporter's account email address if the report was made in the app, or by replying to the email if it was made by email. This does not apply if we cannot reach the reporter.
  • Points of contact and legal representative: Supervisory authorities of EU Member States, the European Commission, the European Board for Digital Services and users can contact us at support@tooo.live (the point of contact under Articles 11 and 12 of the Digital Services Act), in English, Chinese or Korean. The legal representative under Article 13 will be named, with contact details, in this section and in Section 16 once appointed.
  • User numbers: the Service's average monthly active users in the EU are far below the 45 million threshold at which the Digital Services Act designates very large online platforms.

6. Workout safety

6.1 Cycling and other workouts carry a risk of injury or even death. When using the Service, you must follow local traffic rules and laws, pay attention to road and environmental conditions, not operate your phone or look at the screen while riding or exercising, and only exercise when your physical condition allows.

6.2 The data in the Service (location, distance, speed, power, heart rate, etc.) is for reference only. It is not medical advice and is not for diagnosing, treating or preventing any disease. Location, sensor and imported data may be inaccurate or interrupted. If you have any health concerns, consult a doctor before exercising.

6.3 Routes and works in Explore are published by users, and we do not guarantee that they are accurate, safe or suitable for your level. If you follow someone else's route, you judge and bear the risks yourself.

6.4 Background location and long recordings noticeably increase your phone's battery use. Please check your battery yourself, and do not rely on the Service as your only means of navigation or calling for help.

7. Third-party services and content

7.1 The Service uses the following third-party services (see Privacy Policy Section 5): Google Cloud provides servers, databases and file storage; OpenFreeMap and Mapbox provide maps; Apple and Google provide sign-in; an email provider sends verification-code emails; and Apple Health / Health Connect provide workout data when you choose to import it. When using the Service, you also need to follow the third-party terms that apply to you, such as the app store's terms and the terms of your mobile data plan. We are not responsible for the availability or content of third-party services.

7.2 Map data comes from sources such as OpenStreetMap contributors (made available under the Open Database License, ODbL), and the copyright belongs to the respective rights holders. Attribution is shown on the map or under the map's attribution button.

8. Intellectual property

8.1 The rights to the Service's software, interface, trademarks, logos, designs and documentation (excluding User Content and third-party content) belong to us or our licensors.

8.2 We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Service for personal purposes within the scope of these Terms.

8.3 In the works you create, the rights to the templates, styles and visual elements provided by the Service remain with us or our licensors; your own content in the works remains yours. You may use the works for personal purposes and share them on social media and other channels. If you want to use the works for commercial purposes such as advertising or sale, please contact us first.

9. Termination

9.1 You can stop using the Service at any time and request deletion of your account.

9.2 If you seriously or repeatedly violate these Terms or the law, or if continuing to provide the Service would create risks for us or others, we may terminate your account and tell you the reasons under Section 5.2.

9.3 If we end the entire Service, we will notify you by email and with a notice on our website at least 30 days in advance. During this period, you can request your data by email, and we will provide it in the way described in Privacy Policy Section 11.

9.4 After termination, Sections 4.3, 5, 6, 8, 10, 11, 12, 14, 15 and any other terms that by their nature should survive will remain in effect.

10. Disclaimers

10.1 To the maximum extent permitted by law, the Service is provided "as is" and "as available", and we make no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted service and non-infringement.

10.2 We are not responsible for content published by users, or for third-party services.

10.3 This section and Section 11 do not exclude or limit liability that cannot be excluded or limited by law, including liability for losses caused by our intentional misconduct or gross negligence, liability for personal injury or death caused to you, and rights given to you by the consumer protection laws where you live that cannot be excluded by contract.

11. Limitation of liability

11.1 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or goodwill, arising from the use of or inability to use the Service.

11.2 To the maximum extent permitted by law, our total liability to you is limited to the greater of USD 100 (or the equivalent in local currency) and the fees you paid us for the Service in the 12 months before the event.

11.3 To the extent permitted by law, you bear the injuries, property damage or other consequences that arise from your workouts or from using or relying on data from the Service.

12. Governing law and disputes

12.1 These Terms are governed by the laws of the People's Republic of China (for the purposes of these Terms, excluding the laws of the Hong Kong and Macao Special Administrative Regions and Taiwan), without regard to its conflict-of-laws rules.

12.2 Any dispute arising from these Terms should first be resolved through friendly negotiation; if that fails, either party may bring a lawsuit in the competent people's court where we are domiciled.

12.3 If you are a consumer, this section does not affect the protections given to you by the mandatory laws where you live, including the right to sue in the courts where you live under local law and the right to complain to local consumer or data protection authorities. In particular, if you are a consumer in the European Economic Area or the United Kingdom, the mandatory provisions of the law of the place where you live apply to you, and you may also bring proceedings in the courts where you live.

13. Changes to these Terms

We may change these Terms and will update the version and effective date at the top. For major changes, we will notify you by email at least 7 days before they take effect and post a notice on our website; if we cannot reach you by email, the notice on our website applies; if you are in South Korea, we will notify you of changes that are unfavorable to you at least 30 days before they take effect. If you keep using the Service after a change takes effect, you are deemed to accept it; if you do not accept it, please stop using the Service, and you may delete your account. Where the law requires your consent, we will ask for your consent again. After each update, previous versions are archived on our website for you to consult.

14. Additional terms for Apple device users

If you downloaded the Service from the Apple App Store, the following terms also apply; where they conflict with other terms in these Terms, this section prevails:

14.1 These Terms are concluded only between you and us, not with Apple. We, not Apple, are responsible for the Service and its content.

14.2 Your license to use the Service is non-transferable and may be used only on Apple-branded devices that you own or control, in line with the Usage Rules in the App Store Terms (including Family Sharing where they allow it).

14.3 We are responsible for maintaining and supporting the Service; Apple has no obligation whatsoever to provide maintenance and support.

14.4 If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the price you paid for the Service (the Service is currently free). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service; any other claims, losses, liabilities and costs arising from a failure to conform to a warranty will be handled by us under these Terms.

14.5 We, not Apple, are responsible for addressing any claims relating to the Service, including product liability claims, claims that the Service fails to conform to any legal or regulatory requirement, and claims relating to consumer protection or privacy (including those relating to health data).

14.6 If a third party claims that the Service, or your possession and use of the Service, infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.

14.7 You represent and warrant that you are not located in a country or region that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as "terrorist supporting"; and that you are not on any U.S. Government list of prohibited or restricted parties.

14.8 For questions, complaints or claims about the Service, please contact us at the address, phone numbers and email listed in Section 16.

14.9 Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Other

15.1 If any provision of these Terms is found invalid or unenforceable, this does not affect the validity of the other provisions.

15.2 Our failure to exercise a right is not a waiver of it.

15.3 These Terms are provided in Chinese, English and Korean, and each version has equal effect. If the versions are inconsistent, the meaning more favorable to you applies.
